These Terms of Use (the "Terms") govern your access to and use of the eSIMDB website, mobile applications, pages, search and comparison tools, review features, notifications, AI-powered features, chat interfaces, AI agents, external AI channels, APIs, partner interfaces, and any related services that link to these Terms or use eSIMDB data or functionality (collectively, the "Services"). The Services are owned and operated by ROKKODE Inc. ("Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

1. Our Services

eSIMDB is an independent search, comparison, review, and referral platform for travel eSIM plans and eSIM service providers. Our Services help users discover and compare prepaid eSIM plans by destination, provider, price, data allowance, validity period, coverage, network information, promotional offers, user reviews, and other available criteria.

The Services may be made available through our own website or mobile applications, through AI-powered features, or through external AI channels, AI agents, chat interfaces, partner interfaces, or similar technologies.

eSIMDB does not sell, issue, activate, provision, operate, or provide eSIMs, telecommunications services, mobile data, roaming services, or customer support for any eSIM plan unless we expressly state otherwise in writing. eSIM plans listed on the Services are offered and supplied by third-party eSIM providers, mobile network operators, resellers, marketplaces, or other third parties (collectively, "Providers").

When you choose to purchase or use an eSIM plan, your transaction and service relationship are with the relevant Provider, not with eSIMDB. The Provider's own terms, privacy policy, refund policy, support policy, identity verification requirements, fair use policy, acceptable use policy, and other rules may apply.

2. Eligibility and User Responsibilities

You may use the Services only if you are legally able to enter into these Terms and are not prohibited from using the Services under applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for:

confirming that your device supports eSIM and is unlocked;
confirming that the eSIM plan you select is suitable for your destination, travel dates, data needs, device, and intended use;
checking the Provider's latest price, coverage, network, speed, data allowance, validity period, activation rules, refund policy, and other conditions before purchase;
complying with applicable laws, telecommunications rules, travel restrictions, sanctions, import/export rules, and Provider terms;
maintaining the security of any device, email address, or account that you use in connection with the Services.

3. Provider Information and Third-Party Services

The Services may display information about Providers and eSIM plans, including prices, currencies, destinations, coverage, data allowances, validity periods, networks, speed information, plan names, descriptions, images, logos, promotional codes, availability, and user ratings.

This information may be provided by Providers, collected from Provider websites or feeds, submitted by users, generated from our own research, or derived from third-party sources. Although we try to keep information useful and current, eSIM plan details can change frequently and without notice.

We do not guarantee that any Provider or plan information is accurate, complete, current, available, lawful in your location, compatible with your device, or suitable for your needs. You should always confirm the final details on the Provider's website or app before making a purchase.

The Services may contain links to third-party websites, apps, stores, payment pages, support pages, maps, social media pages, or other resources. We are not responsible for third-party services, content, policies, security, transactions, products, refunds, support, or availability. Your use of third-party services is at your own risk.

4. Purchases, Refunds, Activation, and Support

Unless we expressly state otherwise in writing, eSIMDB is not the seller of any eSIM plan listed on the Services. We do not control and are not responsible for:

purchase completion, payment processing, taxes, fees, currency conversion, or invoices;
eSIM delivery, QR codes, activation, installation, top-ups, plan changes, or expiration;
refunds, cancellations, chargebacks, credits, or compensation;
customer support, troubleshooting, identity verification, or account access;
network availability, coverage, speed, latency, throttling, fair use limits, outages, roaming behavior, or service quality;
whether an eSIM plan works in a particular country, region, device, app, or network environment.

Questions about a purchased eSIM plan should be directed to the relevant Provider. eSIMDB may, at our discretion, provide general information or help route users to Provider support, but doing so does not make us responsible for the Provider's services.

5. Rankings, Recommendations, and Comparison Results

The Services may display rankings, filters, sorting, badges, recommendations, "best," "cheapest," "popular," "featured," "sponsored," "review rating," or similar labels. These results are for informational purposes only.

Ranking and comparison results may be based on factors such as price, data allowance, validity, destination, availability, user reviews, Provider information, commercial relationships, promotional campaigns, technical performance, editorial judgment, or other criteria selected by us. Results may change over time and may vary depending on your search, location, device, language, or other context.

We do not guarantee that any listed plan is the best, cheapest, fastest, most reliable, most suitable, or otherwise optimal option for you. You are responsible for making your own purchase decision.

6. AI Features

The Services may include AI-powered features that allow users to search, compare, summarize, ask questions about, or receive recommendations regarding eSIM plans through chat interfaces, AI agents, external AI channels, or similar tools. These AI features may use the same underlying eSIMDB data as our website and mobile applications, but AI-generated outputs may involve summarization, interpretation, inference, or formatting that can be incomplete, inaccurate, outdated, or unsuitable for your circumstances.

AI-generated responses, recommendations, summaries, rankings, or explanations are provided for informational purposes only. We do not guarantee the accuracy, completeness, timeliness, availability, suitability, network performance, purchase availability, or reliability of any AI-generated output.

You must confirm all important details with the relevant Provider before making a purchase or relying on an eSIM plan, including price, data allowance, validity period, coverage, supported countries or regions, supported devices, activation rules, refund terms, identity verification requirements, and other Provider conditions.

If you access the Services through an external AI channel, chat platform, AI agent, or other third-party interface, that third party's terms, privacy policy, technical limitations, availability, account rules, logging practices, and content policies may also apply. We do not control third-party AI channels, their user interfaces, model behavior, account systems, availability, display formats, or data handling practices.

7. Affiliate Links, Advertising, Sponsored Content, and Promotions

The Services may include affiliate links, referral links, promotional codes, advertising, sponsored placements, featured listings, paid campaigns, or other commercial content. We may receive commissions, referral fees, advertising fees, sponsorship payments, discounts, credits, or other compensation when users click links, use codes, view advertisements, or purchase products or services from Providers or other third parties.

Commercial relationships may affect whether, where, or how certain Providers, plans, promotions, or advertisements appear on the Services. However, compensation does not make us responsible for any Provider's products, services, promises, pricing, availability, or support.

Promotional codes, discounts, and offers may be subject to Provider terms, eligibility requirements, expiration dates, regional restrictions, usage limits, or other conditions. We do not guarantee that any promotion will be valid, available, or accepted by a Provider at the time you use it.

8. Reviews and User-Generated Content

The Services may allow users to submit reviews, ratings, comments, feedback, reports, corrections, photos, or other content ("User Content"). Review features may be available without user registration. Because anonymous or registration-free submissions may be difficult to verify, you should treat reviews as personal opinions and not as guaranteed facts.

By submitting User Content, you represent and warrant that:

your User Content is truthful to the best of your knowledge and reflects your genuine experience or opinion;
you have the rights needed to submit the User Content;
your User Content does not violate any law, third-party right, Provider term, confidentiality obligation, or these Terms;
your User Content does not contain personal data of another person without permission;
your User Content is not defamatory, discriminatory, obscene, harassing, threatening, misleading, fraudulent, spam, malware, or otherwise harmful;
you will not submit fake reviews, paid reviews without disclosure, competitor manipulation, review bombing, duplicate reviews, automated reviews, or reviews intended to distort ratings or rankings.

If you are affiliated with a Provider, competitor, advertiser, agency, or other interested party, you must clearly disclose that relationship when submitting User Content.

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, translate, modify, adapt, excerpt, distribute, analyze, and otherwise use your User Content in connection with operating, improving, promoting, and protecting the Services.

We may, but are not required to, review, moderate, edit, refuse, remove, disable, translate, or reformat User Content at any time and for any reason, including suspected violations of these Terms, legal risk, fraud, abuse, low quality, irrelevance, or Provider or user complaints. We do not endorse User Content and are not responsible for its accuracy, reliability, or legality.

9. Prohibited Conduct

You must not:

use the Services for any unlawful, harmful, fraudulent, misleading, abusive, or unauthorized purpose;
scrape, crawl, spider, harvest, index, cache, copy, monitor, or extract data from the Services except as allowed by our robots.txt file or with our prior written permission;
use bots, scripts, automated tools, or bulk access methods to access the Services, submit reviews, manipulate rankings, collect prices, or copy databases;
use AI features for high-volume, automated, abusive, or evasive querying, including attempts to reconstruct eSIMDB datasets or build competing datasets through AI outputs;
use prompt injection, attempted jailbreaks, adversarial prompts, or similar techniques to bypass restrictions, extract system prompts, reveal internal logic, obtain non-public model or infrastructure details, or cause the Services to behave in an unintended manner;
bypass, disable, interfere with, or test rate limits, access controls, security features, anti-abuse systems, or technical restrictions;
attack, overload, disrupt, reverse engineer, decompile, disassemble, or attempt to derive source code from the Services;
use the Services to build, train, enrich, benchmark, or operate a competing product, database, marketplace, comparison service, or commercial dataset without our prior written permission;
reproduce, publish, sell, license, or redistribute AI-generated outputs in a way that misrepresents them as official Provider information, bypasses these Terms, or commercially exploits eSIMDB data without our prior written permission;
copy, reproduce, sell, license, publish, distribute, or commercially exploit our content, plan database, rankings, reviews, Provider listings, UI, or other materials except as expressly permitted by us;
submit false, misleading, malicious, infringing, or illegal User Content;
impersonate another person, Provider, organization, or representative;
interfere with another user's use of the Services;
use the Services in a way that could damage our reputation, Providers, users, or third parties.

We may investigate suspected violations and may block access, remove content, suspend features, limit traffic, notify affected parties, or cooperate with legal authorities where appropriate.

10. Intellectual Property and Data Use

The Services, including our website and app design, software, source code, databases, comparison tools, plan listings, rankings, classification systems, text, graphics, logos, icons, images, interfaces, compilations, and other materials, are owned by us or our licensors and are protected by intellectual property, database rights, unfair competition, and other laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial travel research and comparison purposes.

No rights are granted except as expressly stated in these Terms. You may not use our name, logo, trademarks, screenshots, data, or content in a way that suggests endorsement, partnership, or authorization without our prior written permission.

Provider names, logos, trademarks, and product names belong to their respective owners. Their appearance on the Services does not necessarily imply endorsement, sponsorship, partnership, or approval.

11. Mobile Applications and Platform Terms

If you access the Services through a mobile application, your use of the app may also be subject to the terms, policies, and rules of the applicable app store or platform, including Apple App Store or Google Play terms.

App store operators are not responsible for the Services, content, support, maintenance, claims, or legal compliance related to our app, except to the extent required by their own terms or applicable law. If there is a conflict between these Terms and applicable app store terms, the app store terms may apply only to the extent necessary to resolve that conflict for your app-store relationship.

We may update, change, suspend, or discontinue any app feature at any time, including search, comparison, notification, review, localization, or offline functionality.

12. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that we may process information as described in the Privacy Policy.

If you submit User Content, you should not include sensitive personal information, travel documents, phone numbers, account credentials, QR codes, activation codes, payment information, or information about another person unless you have the legal right to do so.

13. Availability and Changes to the Services

We may update, modify, suspend, limit, or discontinue all or part of the Services at any time, with or without notice. We may also correct errors, remove listings, change rankings, adjust filters, add or remove Providers, update data sources, disable reviews, or change the way information is displayed.

We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, operating system, network, or region.

14. Disclaimers

To the fullest extent permitted by applicable law, the Services and all information, content, rankings, listings, reviews, links, promotions, and materials are provided on an "as is" and "as available" basis.

We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, availability, security, and course of dealing.

We do not warrant or represent that:

any Provider information or eSIM plan information is accurate, current, complete, or available;
any eSIM plan will work with your device, destination, carrier, network, travel schedule, or intended use;
any Provider will honor a listed price, promotion, refund, support request, or service claim;
any ranking, recommendation, rating, or review will be correct, unbiased, or suitable for you;
any AI-generated output will be accurate, complete, current, available, reliable, or suitable for you;
the Services will be uninterrupted, secure, error-free, or free from harmful components.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by applicable law, ROKKODE Inc. and its affiliates, directors, officers, employees, contractors, agents, licensors, partners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for any loss of profits, revenue, business, data, goodwill, travel opportunity, connectivity, or device functionality, arising out of or relating to the Services or these Terms.

To the fullest extent permitted by applicable law, we will not be liable for any damages, losses, costs, or claims arising out of or relating to the Services or these Terms, except where liability cannot be excluded under applicable law.

The limitations in this section apply whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if we have been advised of the possibility of damages. These limitations do not limit liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless ROKKODE Inc. and its affiliates, directors, officers, employees, contractors, agents, licensors, partners, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

your access to or use of the Services;
your violation of these Terms;
your User Content;
your violation of any law or third-party right;
your interaction, transaction, dispute, or relationship with any Provider or third-party service;
your misuse of Provider information, plan data, reviews, rankings, or other content from the Services.

We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

17. Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, if we believe that you have violated these Terms, created risk for us or others, submitted abusive or fraudulent content, used automated access, or otherwise misused the Services.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including sections concerning intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date above. Changes are effective when posted unless a different effective date is stated.

If we make material changes, we may provide additional notice through the Services, by email, in-app notice, or other reasonable means where appropriate. Your continued use of the Services after the updated Terms become effective means that you accept the updated Terms. If you do not agree, you must stop using the Services.

19. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of Japan, without regard to conflict of law principles.

The Tokyo District Court in Japan will have exclusive jurisdiction as the court of first instance over any dispute arising out of or relating to these Terms or the Services, except where applicable law requires a different forum or gives you rights that cannot be waived by contract.

20. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms that apply to specific features, constitute the entire agreement between you and us regarding the Services.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect, and the invalid or unenforceable provision will be interpreted to achieve its intended purpose to the greatest extent permitted by law.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
